A client sells shares on a Monday. With no public holidays, the shares reach his CDS account as Tradeable Balance at 11.00 a.m. on Wednesday. What happens?
Schedule 2 gives the seller two windows to have the shares as Tradeable Balance: by 4.30 p.m. on T+1 for the first batch settlement-run, or by 11.30 a.m. on T+2 for the second batch. Its footnote says buying-in without notice under Rule 9.05(1) starts only if the seller misses the second-batch time. 11.00 a.m. on Wednesday (T+2) meets it, so the shares are delivered to the buyer in the second batch, by 2.00 p.m. on T+2. Missing the T+1 window alone does not trigger buying-in. Cash settlement follows only an unsuccessful buying-in. Buying-in is held on T+2, not T+3. Treating the first-batch deadline on T+1 as the point of default.
